These Terms of Use ("Terms") govern your access to and use of the website at digitalprojection.com and any related digital services, content and tools (together, the "Website") operated by Digital Projection Limited. Please read these Terms carefully before using the Website. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Website.

By accessing, browsing or otherwise using the Website you confirm that you accept these Terms and that you agree to comply with them. These Terms apply together with our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. If you are using the Website on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

You may use the Website only for lawful purposes and in accordance with these Terms. We grant you a limited, non-exclusive, non-transferable and revocable permission to access and view the Website for your own information and for legitimate business purposes relating to our Products.

You agree that you will not:

  • use the Website in any way that breaches any applicable local, national or international law or regulation;
  • use the Website to transmit any unsolicited or unauthorised advertising or promotional material;

We reserve the right to withdraw or amend the Website, and any service or material we provide through it, without notice. We will not be liable if for any reason the Website is unavailable at any time or for any period.

4. Intellectual property rights

The Website and its Content are owned by or licensed to Digital Projection and are protected by copyright, trade mark, database and other intellectual property laws. All such rights are reserved. "Digital Projection", "INSIGHT", "TITAN", "M-Vision", "E-Vision", "Satellite MLS", "Radiance LED", "ColorBoost", "Nexus" and associated logos are trade marks of Digital Projection Limited or its group companies. Other product and company names mentioned on the Website may be the trade marks of their respective owners and are acknowledged accordingly.

You may print or download extracts of Content for your own personal, non-commercial reference, provided you do not modify the material and you retain all copyright and proprietary notices. You must not use any part of the Content for commercial purposes without obtaining a licence from us. Reproduction is prohibited other than in accordance with the copyright notice that forms part of these Terms.

5. Product information and specifications

We take care to ensure that information about our Products on the Website is accurate. However, Product information, specifications, brightness figures, resolutions, dimensions, availability and pricing are provided for general guidance only and are subject to change without notice as we continually develop and improve our Products.

The Content may contain technical inaccuracies or typographical errors. Images of Products are for illustration only and the actual Product supplied may differ. Nothing on the Website constitutes an offer to sell, and no Product specification on the Website forms part of any contract of sale unless expressly incorporated in writing. You should confirm current specifications with us or with an authorised dealer or distributor before relying on them for any installation or purchasing decision.

6. Warranty

Any warranty applicable to our Products is governed by the separate written warranty terms supplied with the relevant Product or made available through our warranty pages, and not by these Terms. Warranty cover, duration and claim procedures vary by Product, region and route to market. Please refer to the applicable regional warranty documentation, or contact your authorised dealer, distributor or our customer care team, for the warranty terms that apply to your Product.

Nothing on the Website extends, varies or replaces those separate warranty terms.

7. Software and firmware downloads

Where we make Downloads available through the Website, we grant you a limited, non-exclusive, non-transferable licence to use the relevant software or firmware solely with the Digital Projection Products for which it is intended, and in accordance with any additional licence terms, release notes or documentation supplied with the Download.

You must not decompile, reverse engineer, disassemble, modify or create derivative works of any software or firmware except to the extent expressly permitted by applicable law. Downloads are provided "as is"; you are responsible for ensuring that a Download is compatible with your Product before installation, and for maintaining appropriate backups. We are not liable for any loss or damage arising from the incorrect installation or use of any Download.

8. Third-party links

The Website may contain links to third-party websites, resources and services, including the websites of Delta Electronics, authorised dealers, distributors and partners. These links are provided for your convenience and for further information only. We have no control over the content of those sites or resources, and the inclusion of any link does not imply our endorsement of the linked site. We accept no responsibility for the content, products, services or privacy practices of any third-party website, and you access them at your own risk.

9. Enquiries and submissions

If you contact us or submit an enquiry through the Website, you are responsible for ensuring that the information you provide is accurate and that you are entitled to provide it. We will handle the personal data in any Submission in accordance with our Privacy Policy.

Your enquiry may be passed to a member of our internal sales team or, where appropriate, to an authorised dealer or distributor in your region so that we can respond to it. You must not submit any material that is unlawful, defamatory, infringing of third-party rights or confidential to a third party. We are not obliged to act on, respond to or retain any Submission, and any reliance you place on a response is at your own risk.

10. Disclaimers

The Website and all Content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no representations or warranties of any kind, express or implied, as to the accuracy, timeliness, performance, completeness or suitability of the Website or the Content for any particular purpose.

Your use of any information or material on the Website is entirely at your own risk, and it is your responsibility to ensure that any Products, services or information available through the Website meet your specific requirements. We do not warrant that the Website will be uninterrupted, error-free or free of viruses or other harmful components.

11. Limitation of liability

15. Changes to these Terms

We may revise these Terms at any time by amending this page. You should check this page from time to time to take notice of any changes, as they are binding on you. Where we make material changes, we will take reasonable steps to bring them to your attention, for example by posting a notice on the Website. 17. Severability and entire agreement

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Digital Projection in relation to your use of the Website and supersede any prior agreement or understanding on that subject.
